General Terms and Conditions of Schaffhauserland Tourismus

§ 1 Applicability to businesses and entrepreneurs and definitions of terms
(1) The following general terms and conditions apply to all services between us and a consumer in the version valid at the time of the order.
(2) "Consumer" in these terms and conditions, is any natural person who concludes a legal transaction for a purpose which can be attributed neither to their commercial nor their self-employed activity.

§ 2 Conclusion of contract, storing of wording of contract
(1) The following rules and regulations on the conclusion of the contract apply to orders made via our Internet shop

(3) The presentation of the goods in our Internet shop do not constitute any legally binding contractual offer on our part, but only have a non-binding request to the consumer, to order goods. Upon ordering the desired goods, the consumer gives a binding offer to conclude a purchase contract. The acceptance of the offer is made in writing or in text form or by sending the ordered goods within a week. After unsuccessful expiry of the period the offer is deemed to be rejected.
(4) Upon receipt of an order in our Internet shop, the following rules apply: The consumer submits a binding contract offer by successfully going through the ordering procedure provided for, in our Internet shop. The order is placed as follows:
1) Selection of the desired goods
2) Confirmation by clicking the button "send"
3) Checking of the information in the shopping cart
4) Pressing of the button “send”
Before sending the binding order, the consumer can return to the website with all the information by pressing the ‘return’ button in the Internet browser, and recheck the order details, to if necessary correct any input errors made, or resp. to cancel the order process by closing the web browser.
We acknowledge receipt of the order immediately by an automatically generated email (confirmation). This does not represent an acceptance of the offer yet. The acceptance of the offer is in writing, in text form or by sending the ordered goods within one week.
(5) Storage of the wording of the contract with orders via our Internet shop: we will send you the order data and our general terms and conditions via email. The terms and conditions can also be accessed at any time on http://www.schaffhauserland.ch
Your order data is no longer accessible via the Internet due to safety reasons.

§ 3 Prices, shipping costs,  payment, payment date
(1) The indicated prices include the legal value added tax and any other price components. Any shipping costs will be added.
(2) The consumer has the possibility of payment in advance, cash on delivery.
(3) If the consumer has chosen, payment in advance, he is, therefore, obliged to pay the purchase price immediately after conclusion of the contract. Where we provide cash on delivery, the purchase price claim is due with receipt of the goods.

§ 4 Delivery
(1) If we have not clearly stated this otherwise in the product specification, all items offered by us are ready for shipping.
(2) If the consumer has chosen, payment in advance, we will not send the goods before receipt of payment.

§ 5 Reservation of ownership
We reserve the ownership of the goods until full payment of the purchase price has been made.
§ 6 Cancellation right

You can cancel your contractual declaration within 14 days without giving reasons in written form (e.g. letter, fax, email), or also - if the goods have been provided before expiry of the deadline – by returning the goods. The deadline begins after receipt of this policy in text form, but not before receipt of the goods by the recipient (in the recurring supply of similar goods not before receipt of the first partial delivery) and also not prior to fulfilment of our information obligations in accordance with article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB, as well as our obligations according to § 312 g para. 1 sentence 1 BGB in conjunction with article 246 § 3 EGBGB. In order to observe the cancellation period, the timely dispatch of the cancellation or the goods is sufficient.

Consequences of cancellation
In the event of a valid cancellation each party shall return to the respective other party the benefits received and any benefits derived (e.g. interest).
In the event that you cannot return the benefits received and benefits derived (e.g. the benefits gained), in whole or in part or only in a worse state, you shall be obliged to compensate us for any deterioration.
For the deterioration of the product and for benefits derived you must pay compensation only as far as the usage or deterioration can be attributed to the handling of the matter, which extends beyond examination of properties and functions. “Examination of the properties and functionality" refers to the testing and trials of the respective goods, such as is possible and common in the shop. Goods consignable by parcel shipment may be returned at our risk. You have to pay the regular costs of the return shipment if the delivered goods correspond to the ordered and if the price of the returned goods does not exceed an amount of 40 euro or when the goods are of a higher price, and you have at the time of cancellation not yet agreed on the compensation or effected a contractually agreed partial payment. Otherwise, the return is free of charge for you. The goods in your possession that are not consignable by parcel shipment will be picked up. Obligations for refunding of payments must be fulfilled within 30 days. The deadline begins with your dispatch of the cancellation notice or the goods in question, for us it starts with receipt of same.

§ 7 Contractual arrangement with regard to the return costs for  cancellations
If you make use of your right to cancel, the following agreement applies, in accordance with § 357 para. 2 BGB, that you bear the costs of returning the goods, if the delivered goods correspond to the ordered and if the price of the returned goods does not exceed an amount of 40 euro or when the goods are of a higher price, and you have at the time of cancellation not yet agreed on the compensation or effected a contractually agreed partial payment.
Otherwise, the return is free of charge for you.

§ 8 Contract language
The German version is the exclusive
contract language.

Terms Packages

1. Area of Application
The General Terms presented are an integral part of the agreement between you, as the customer, and Schaffhauserland Tourism (SHLT), subject to SHLT being the organiser – e.g. with package tours (also called, ‘packages’). To be considered valid as a pack-age tour, a minimum of two of the following services must be specified in advance, if this combination is to be offered as an all-in price, and lasts longer than 24 hours or an overnight stay is included: a) transportation; b) accommodation; c) other touristic services, that are not additional services for transportation or accommodation and that make up a considerable part of the total package. The ‘AVRB’ Terms and Conditions are valid for all travel participants. In cases where SHLT acts as intermediary with only one other organiser, accommodation provider or another service provider then the general contract terms of that partner apply.
2. Contract Conclusion
The contract is valid when there is an oral or written booking. Early bookings will generally be confirmed in writing by SHLT.
3. Services
The services are listed in the description of the respective offers. Where options are listed, (e.g. various hotels), they will be designated according to availability by SHLT. Where possible, any preferences on behalf of the customer will be observed.
4. Prices
The valid price is the one agreed upon prior to the booking of the individual package. The prices quoted in foreign currency are recommended prices. On payment the actual exchange rate of the day applies.
5. Terms of Payment
Unless otherwise agreed, payment is to be made by invoice (account details or payment slip for transfer), resp. directly at the counter, (cash/Maestro/credit card). Payment terms, stated on the invoice, are generally 30 days.
6. Change in Prices or Services
Change in prices regarding standard price examples published earlier or changes in services are possible, as long as the character of the service rendered is maintained. The services and prices defined at the time of booking are valid. As a rule, an individual offer is made prior to your booking. Should a major change be made after the booking, you can accept the change or withdraw from the contract.
7. Cancellation of a Package Tour by SHLT
SHLT reserves the right to cancel an offer/service where necessary, if compelling reasons justify this action. In this case any possible advance payments will be fully reimbursed or an alternative date or alternative offer will be made.
8. Cancellation Terms
For cancellations on your part, unless otherwise agreed, the following terms of cancellation apply.
Cancellations after receipt of the definite confirmation: 10 % of the total costs, but min. CHF 50.-
Cancellation less than 3 days prior to start: 50 % of the total costs
Cancellation less than 24 hours prior to start or no-show: 100 % of the total costs
As guarantee, especially for hotel bookings, a credit card number and other relevant details can be requested. We highly recommend, particularly for large amounts, to take out cancellation insurance. Should you not be able to participate due to health rea-sons, then the booked tour can be transferred to one or more persons, as organised by you, as replacement/s, to an equivalent extent.
9. Complaints / Disagreement
Should there be any complaint to lodge, it should be reported immediately and directly on location, so that the problem can possibly, be solved. If you are not satisfied with the services provided, we kindly ask you to contact us immediately.
10. Liability
SHLT is only liable for any damage incurred, in the event of SHLT being responsible and for which it is formally and legally bound. Liability for theft and damage of valuables and baggage cannot be accepted. Please ensure that you have the necessary insurance, especially, a valid health and accident insurance.
11. Act of God
SHLT and its partners reserve the right, also in your interest, to change the itinerary, resp. the accommodation, when unforeseen circumstances occur and it is deemed necessary. We will seek to provide comparable substitute services.
12. Applicable Law and Place of Jurisdiction
Only Swiss Law is applicable regarding the legal contract, in particular, regarding the Federal Law pertaining to package tours and holidays (SR 944.3). Place of jurisdiction is Schaffhausen.

Additional terms - Guided tours

1. Scope
1.1. These general contractual conditions govern the contractual relationship between you and Schaffhauserland Tourismus for all guided tours organised by Schaffhauserland Tourismus.
2. Conclusion of contract
2.1. The contract is concluded upon acceptance of your booking with Schaffhauserland Tourismus in writing (letter, e-mail, fax or internet), by phone or on site at one of our tourist offices.
3. Terms of payment
3.1 Invoice by mail or e-mail.
3.2 All prices are in Swiss francs including the statutory VAT.
4. Group size
4.1 The maximum group size is published on www.schaffhauserland.ch in the corresponding guided tour. Larger groups need parallel guiding.
5. Express surcharge
5.1 An express surcharge will be due (CHF 40.00 for the first, CHF 30.00 for each other guide), if a booking is made only one day before the tour date.
6. Cancellation charge
6.1 Non-appearance of the group (no show): 100 % of the costs.
6.2 Cancellation less than 48 hours prior to the guided tour: 100 % of the costs.
6.3 Cancellation more than 24 hours prior to the guided tour: processing fee of CHF 40.00.
7. Delays
7.1 In case of delays, the duration of the guided tour will be reduced correspondingly or an additional fee of CHF 40.00 for every 15 minutes or part thereof has to be paid cash to the guide.
8. Change of booking by customer
8.1 For changes (e.g. time, place) after receipt of the confirmation an additional fee of CHF 40.00 will be charged.
9. Miscellaneous
9.1 The tours take place in all weather conditions and are made on foot. Please pay attention to appropriate footwear.
9.2 Price changes are left. All rates are including 8 % VAT.
9.3 Tour operators receive a reduction of 10 % on our offer of guided tours except Night Watchman tours.
10. Liability
10.1 In case of an accident during the tour we assume no liability. Insurance is the participants own responsibility
11. Applicable law and place of jurisdiction
11.1 Only Swiss law is applicable for the contractual relationship. Court of jurisdiction is Schaffhausen.
